We reserve the right to showcase completed projects, including images, videos, and other creative content, as part of our portfolio on our website, social media platforms, and other promotional materials. This will only be done with the client's prior consent. We value the privacy and preferences of our clients and will never display or share any content without expressed permission.

The user is responsible for their own actions while using our website and for any consequences thereof.

Our website may contain links to third-party websites for your convenience and information. These links do not signify endorsement or approval of the content, practices, or policies of the linked websites. Equipment Rental Terms and Conditions
These terms govern all equipment hire through Tarf Media's Equipment Rental Portal. By creating an account and using the rental service, you agree to the following.
a General Terms
Tarf Media offers professional media production equipment for hire, including cameras, lenses, drones, lighting, sound gear, and accessories. All rentals are subject to availability and must be booked in advance. All clients must create a Tarf Media account to access, reserve, or hire equipment.
b Account Registration and Verification
- Account Requirement: All equipment rental clients must register for a Tarf Media Account before hiring equipment.
- Identity Verification: Clients must upload a valid copy of their National ID or Passport, along with a guarantor's National ID or Passport, during registration. Corporate clients may also be required to submit a company authorisation letter.
- Account Responsibility: Clients are responsible for maintaining the confidentiality of their account credentials and all activity under their account.
- Approval: Tarf Media reserves the right to approve or decline any account registration or equipment hire request at its discretion.
c Booking and Payment
- Clients may browse available equipment, select items, and submit a booking request via the portal.
- Tarf Media will issue an official invoice once the booking is confirmed.
- A 50% deposit is required to secure a booking; the balance must be paid before the equipment is collected or dispatched unless otherwise agreed.
- All prices are quoted per day unless stated otherwise.
d Equipment Collection and Use
- Equipment will only be released once verification is confirmed and payment is completed.
- Clients must inspect and confirm the condition of equipment at collection.
- The hirer must communicate in advance if the equipment will be collected by their agent or staff.
- The equipment must be used responsibly and only for lawful, professional purposes.
- Any misuse, unauthorised modifications, or illegal use will result in immediate termination of the rental agreement and potential legal action.
e Damage, Loss, or Theft
- The client assumes full responsibility for any loss, damage, or theft of the rented equipment during the rental period.
- Clients are responsible for the full replacement or repair cost based on the current market value.
- In the event of loss of equipment, the hirer will be charged 75% of the prevailing daily rate until the equipment is replaced or returned.
- Equipment should not be opened, repaired, or altered by anyone other than Tarf Media personnel.
f Returns and Late Fees
- All equipment must be returned on or before the agreed date and time.
- Late returns attract additional charges per hour or per day, depending on the delay.
- Equipment must be returned in the same condition it was issued.
g Crew Hire
When hiring Tarf Media's crew along with equipment, the crew operates under Tarf Media's management. Clients should not assign additional tasks outside the agreed project scope without prior written consent.
h Liability
Tarf Media is not liable for any injuries, losses, or damages arising from the use or misuse of rented equipment. Clients assume full responsibility once the equipment leaves our premises.
i Cancellations and Refunds
- Cancellations made within 24 hours of the scheduled rental date may incur up to 50% of the rental fee.
- Failure to collect equipment after booking confirmation results in forfeiture of the booking fee.
- Refunds, if applicable, will be processed within 5 business days.
j Ownership
- All rented equipment remains the sole property of Tarf Media.
- Clients are not permitted to sublet, sell, transfer, or pledge the equipment to third parties.
k Portal Use and Suspension
- Tarf Media may suspend or terminate a client's account in cases of fraud, policy violation, or misuse of services.
- System access may be temporarily unavailable during maintenance or upgrades.
File Storage and Backup Policy
This policy governs how Tarf Media stores, manages, and handles client project files after delivery.
a Local Backup
Tarf Media maintains secure local backups of completed client projects for a period of two (2) years from the date of delivery. This backup provides clients with an extra layer of security in case files are lost, corrupted, or accidentally deleted on their end. After the two-year period, all backup files are automatically and permanently deleted from our systems without prior notice. Clients are encouraged to download and safely store their final files upon delivery.
b Online File Delivery
Completed project files are delivered through Tarf Media's secure Online Gallery — a private, password-accessible viewer where clients can preview, download, and manage their delivered content. Each gallery is accessible via a unique link sent directly to the client upon project completion.
- Full Access: Clients who have met all payment obligations at the time of delivery will receive immediate, unrestricted gallery access with downloads fully enabled.
- Outstanding Payments: Where a client has an outstanding balance at the time of delivery, the gallery will be published in preview-only mode — the client may view the content but downloads will be disabled. If payment is not received within 24 hours of the gallery link being issued, the gallery will be suspended and access removed entirely.
- Reinstatement: Full gallery access, including downloads, will be reinstated within 24 hours of payment being confirmed.
- Availability Window: Gallery links remain active for three (3) months from the original date of delivery, regardless of when payment is made. After this period, links will automatically expire.
- Client Responsibility: Clients are responsible for downloading and securely storing their files within the availability window. Tarf Media will not be liable for expired or inaccessible gallery links after the stated period.
c Data Privacy and Security
All client files are securely stored and handled in accordance with Kenya's Data Protection Act (2019). Access to backup files is restricted to authorised Tarf Media personnel only. We do not share, sell, or distribute client files to any third party without written consent.
d File Retrieval Requests
Clients may request retrieval of backup files during the two-year retention period. Retrieval may take up to three (3) working days and may attract a small administrative fee depending on file size and storage requirements.
e Limitation of Liability
While Tarf Media employs industry-standard data protection and backup measures, we do not guarantee the indefinite preservation of files. We shall not be held responsible for data loss resulting from hardware failure, system corruption, natural disasters, or other circumstances beyond our control.
Email Marketing
These terms cover Tarf Media's own marketing communications to subscribers, as well as email marketing delivered as a service to clients.
a Subscriber Consent
Tarf Media sends marketing emails only to individuals who have explicitly opted in — whether through our website's subscribe form, a direct request, or a prior service engagement where consent was given. By subscribing, you agree to receive periodic communications from Tarf Media including project showcases, service updates, industry insights, and special offers.
b Unsubscribing
You may unsubscribe from Tarf Media's marketing emails at any time by clicking the unsubscribe link included in every email, or by contacting us at info@tarfmedia.co.ke. Unsubscribe requests are processed promptly. We may retain a record of your consent history in accordance with our data retention obligations under Kenya's Data Protection Act (2019).
c Subscriber Data
Email addresses and names collected for marketing purposes are used solely for sending our communications and are never sold, shared, or transferred to third parties. All subscriber data is handled in accordance with our Privacy Policy.
d Email Marketing as a Client Service
Where Tarf Media delivers email marketing campaigns on behalf of a client, the client is responsible for ensuring that their subscriber list was obtained with proper consent and in compliance with applicable law, including Kenya's Data Protection Act (2019) and any applicable anti-spam regulations. Tarf Media will not send unsolicited commercial emails on behalf of clients and reserves the right to decline any campaign that does not meet these standards.
e Content Responsibility
For client-commissioned email campaigns, the client retains responsibility for the accuracy and legality of all content. Tarf Media assumes no liability for claims arising from the content of client-directed email communications.
f Platform Tenant Accounts
In addition to managed campaigns, Tarf Media's email marketing platform is available to registered tenants — businesses and individuals who self-register to create and send their own campaigns independently. By registering as a tenant, you agree to the following:
- Account Registration: Tenants must register for an account and provide accurate business and contact details. Access to the platform is subject to Tarf Media's approval.
- Acceptable Use: Tenants may only use the platform to send campaigns to contacts who have explicitly consented to receive communications from the tenant's business. Sending unsolicited, deceptive, or unlawful emails is strictly prohibited.
- Independent Operation: Tenant campaigns are created, managed, and sent by the tenant. Tarf Media does not review, moderate, or endorse tenant campaign content unless explicitly engaged to do so.
- Legal Compliance: Tenants are solely responsible for ensuring their campaigns comply with all applicable laws, including Kenya's Data Protection Act (2019) and any relevant anti-spam regulations. Tarf Media shall not be liable for any tenant's failure to comply.
- Suspension and Termination: Tarf Media reserves the right to suspend or permanently terminate any tenant account that violates these terms, generates high complaint rates, or is used for unlawful purposes, without prior notice.
g Tenant Subscriber Data
Subscriber lists uploaded or built by a tenant on the platform remain the property of that tenant. Tarf Media processes tenant subscriber data solely to facilitate the delivery of the tenant's campaigns and does not use that data for Tarf Media's own marketing, share it with other tenants, or disclose it to third parties except where required by law. Tenants are responsible for ensuring they have the legal right to hold and use any data uploaded to the platform.
